Santiago Mill Occupancy and Use Restrictions

Pursuant to 16 United States Code (U .S.C.) §551 and 36 Code of Federal Regulations (C.F.R.) § 261.50(a) and (b), the

following acts are prohibited on all National Forest System lands described below.


When provided in an order, it is prohibited to go into or be upon an area which is closed for the protection

of: public health or safety. 36 CFR 261.53(e).

When provided by an order, the following are prohibited: Using any type of vehicle prohibited by the order.

36 CFR 261.54(a).


Pursuant to 36 C.F.R. § 261.50 (e), the following persons are exempt from specified Prohibitions of this order:

1) Persons with a valid Forest Service permit or contract specifically authorizing the otherwise prohibited act

or omission.

2) Any federal, state or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.


Located within the Clear Creek Ranger District of the Roosevelt National Forest Clear Creek County in the State of Colorado (the " Restricted Area") and on all roads located within the Restricted Area (the "Restricted Roads") . The Restricted Area is depicted on the attached map, hereby incorporated into this Order as Exhibit A, and described below. This includes any structures or improvements associated with the Santiago Mill site, including, but not

limited to the bunkhouse, trestle, ore bin, water tank and any other accessary structures.

The purpose of this order is to protect public health and safety.

This Order will be in effect when signed and will remain in force until rescinded or until 12/31/2022, whichever event occurs first.

Violation of these prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for an

individual or $10,000.for an organizations, or imprisonment for more than six months, or both  

16 U.S.C. § 551 and

18 USC§§ 3559 and 3571.
